Throughout these Terms of Service, the terms “we”, “us” and “our” refer to Tidies s.r.o.

Our online store is hosted on the Shopify platform, which enables us to offer and sell our products and services to customers.

These Terms of Service govern the use of our website and purchases made through our online store. Our Privacy Policy, Return and Refund Policy, Shipping Policy and other policies displayed in the online store form part of these Terms where applicable.

Nothing in these Terms limits any mandatory rights granted to consumers under applicable Slovak or European Union law.

2. Use of the online store

You may use our online store only for lawful purposes.

When placing an order, you must provide accurate, current and complete information, including your contact, billing and delivery information.

If you create a customer account, you are responsible for maintaining the confidentiality of your login details and for activity carried out through your account. Please notify us without undue delay if you suspect any unauthorised use of your account.

You may not interfere with the security or proper operation of the website, introduce malicious software, attempt to gain unauthorised access to the website or use its content in violation of applicable law.

3. Product information

We make reasonable efforts to ensure that product descriptions, photographs, dimensions, colours, availability and other information shown in the online store are accurate.

The appearance of colours and products may vary depending on the screen, device and display settings used by the customer.

Minor variations that do not affect the functionality or essential characteristics of a product do not constitute a defect. This does not limit the customer’s statutory rights where the delivered product does not conform to the contract.

Products are available while stocks last or, where expressly stated, may be ordered from a supplier. We may discontinue a product or limit the quantity available for purchase.

4. Ordering process and conclusion of the contract

The presentation of products in the online store constitutes an invitation to place an order and not a binding offer by us.

By completing the checkout and submitting an order, you make a binding offer to purchase the selected products.

After the order is submitted, we will send you an electronic confirmation that the order has been received. The purchase contract is concluded when we expressly accept the order or dispatch the ordered products, depending on which occurs first.

We may refuse or cancel an order for legitimate reasons, including:

  • the product is unavailable;

  • the payment could not be authorised;

  • the information provided by the customer is incomplete or demonstrably incorrect;

  • there is an obvious pricing or product-information error;

  • we reasonably suspect fraud, misuse or unlawful activity;

  • delivery to the selected destination is unavailable.

If an order that has already been paid is not accepted or is cancelled by us, we will refund the corresponding payment without undue delay.

The customer should review the order carefully before submitting it. If you wish to change or cancel an order, contact us as soon as possible at eshop@tidies.sk. We cannot guarantee that an order can be changed or cancelled after it has entered the fulfilment or dispatch process. This does not affect the consumer’s statutory right of withdrawal.

5. Prices and payment

The price applicable to an order is the price displayed at the time the order is submitted.

Prices displayed to consumers include applicable value added tax unless expressly stated otherwise. Delivery charges and any other applicable charges are shown separately before the order is submitted.

Customers ordering delivery to a country outside the European Union may be responsible for customs duties, import taxes or similar charges imposed by the destination country. Where applicable, these charges are not included in the purchase price unless expressly stated during checkout.

Available payment methods are displayed during checkout. Payment is processed through the selected payment provider and may be subject to that provider’s terms and security checks.

If prices are displayed in a currency other than the final transaction currency for information purposes, the applicable transaction currency and final amount payable will be clearly displayed before the order is submitted.

Promotional codes and discounts are subject to their stated conditions, validity period and product eligibility. Unless expressly permitted, promotional offers may not be combined.

6. Delivery

We deliver to the countries and regions available for selection during checkout.

Available delivery methods, estimated delivery times and applicable delivery charges are displayed before the customer submits the order.

Delivery periods are estimates unless a binding delivery date has been expressly agreed. We will deliver the goods without undue delay and no later than the period required by applicable consumer law, unless another delivery period has been agreed with the customer.

We are not responsible for delays caused by circumstances outside our reasonable control. If a significant delay occurs, we will inform the customer where reasonably possible and explain the available options.

For consumer purchases, the risk of loss or damage passes to the customer when the customer, or a third party designated by the customer other than the carrier, physically receives the goods.

If the customer independently commissions a carrier that was not offered by us, risk may pass when the goods are handed over to that carrier, to the extent permitted by applicable law.

The customer is responsible for providing a correct and complete delivery address and for accepting delivery. Additional costs caused by an incorrect address or an unjustified failure to accept delivery may be charged to the customer where permitted by law.

7. Right of withdrawal and returns

Consumers purchasing at a distance generally have the right to withdraw from the purchase contract within 14 days without giving a reason, subject to the conditions and exceptions established by applicable law.

Detailed information about exercising the right of withdrawal, returning goods, return shipping and refunds is provided in our Return and Refund Policy, which forms part of these Terms.

Tidies s.r.o. covers the cost of return shipping where stated in the Return and Refund Policy and where the return is arranged in accordance with our provided instructions.

The statutory right of withdrawal is separate from rights relating to defective or non-conforming goods.

8. Conformity of goods and statutory guarantee

We are responsible for ensuring that goods supplied to consumers conform to the purchase contract and meet the requirements of applicable consumer law.

If a product is defective or does not conform to the contract, the consumer may be entitled to repair, replacement, a reasonable price reduction or termination of the contract, depending on the circumstances and the requirements of applicable law.

These statutory rights are not affected by any commercial warranty offered by a manufacturer or another party.

To report a defective or non-conforming product, contact us at eshop@tidies.sk and provide the order number, a description of the issue and, where reasonably possible, photographs showing the problem.

9. Digital products and digital content

Where we supply digital content, such as an electronic book or downloadable material, additional statutory rules concerning digital content apply.

Where the customer requests immediate access to digital content before the expiry of the 14-day withdrawal period, we may ask the customer to expressly consent to immediate performance and acknowledge that the right of withdrawal will be lost once the supply of the digital content has begun, where permitted by law.

If the legally required express consent and acknowledgement have not been obtained, the customer’s statutory withdrawal rights remain unaffected.

Digital content may be used only for the customer’s personal, non-commercial purposes unless expressly agreed otherwise. It may not be reproduced, distributed, resold, made publicly available or commercially exploited without our written permission.

10. Intellectual property

The website and its original content, including texts, photographs, graphics, logos, designs, videos and other materials, are protected by copyright, trademark and other intellectual-property laws.

Content owned by us may be used only for personal and non-commercial purposes connected with browsing or purchasing from the online store.

You may not copy, reproduce, modify, distribute, publish, sell or commercially exploit protected content without the prior written consent of the relevant rights holder.

Product names, trademarks and other content belonging to third parties remain the property of their respective owners.

11. Customer reviews and submitted content

If you submit a product review, photograph, comment or other content, you confirm that you have the necessary rights to submit it and that it is not unlawful, misleading, abusive, defamatory or infringing on the rights of another person.

You grant us a non-exclusive, worldwide and royalty-free right to display and reproduce the submitted content for the purpose of operating and promoting our online store, subject to applicable data-protection and consumer-protection laws.

We may refuse or remove content that violates applicable law, these Terms or the rights of another person. We will not suppress or manipulate genuine reviews merely because they are critical.

Where a review was submitted in exchange for an incentive, this fact must be clearly disclosed.

12. Third-party services and links

Our website may include services, payment methods, applications or links provided by third parties.

Third-party services are governed by their own terms and privacy policies. We are not responsible for the independent content or operation of third-party websites, except where liability cannot be excluded under applicable law.

Shopify provides the technical e-commerce platform used by our store. However, the purchase contract is concluded directly between the customer and Tidies s.r.o. Shopify is not the seller of the products offered in our online store.

13. Personal data

We process personal data in accordance with applicable data-protection legislation, including the General Data Protection Regulation.

Detailed information about the categories of personal data processed, purposes and legal bases of processing, recipients, retention periods and customer rights is available in our Privacy Policy.

Shopify and other service providers may process personal data on our behalf or for purposes described in the relevant privacy notices.

14. Website availability and errors

We aim to keep the online store available and accurate, but we cannot guarantee uninterrupted or error-free access.

We may temporarily restrict access for maintenance, security, updates or circumstances outside our reasonable control.

Obvious technical, typographical or pricing errors may be corrected. If an error affects an order already placed, we will inform the customer and provide an appropriate option, such as confirming the order at the correct price or cancelling it with a full refund.

15. Liability

We are liable for breaches of our contractual and statutory obligations in accordance with applicable law.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for death or personal injury caused by negligence, deliberate misconduct, fraud or infringement of mandatory consumer rights.

We are not liable for indirect losses that were not reasonably foreseeable when the contract was concluded, except where applicable law provides otherwise.

For customers purchasing in the course of business, additional limitations permitted by applicable law may apply. These limitations do not apply to consumers where they would restrict mandatory statutory rights.

16. Force majeure

We are not responsible for a failure or delay caused by circumstances outside our reasonable control, including natural disasters, war, civil unrest, epidemics, government measures, major failures of transport or communication systems, cyberattacks or disruptions affecting suppliers and carriers.

This provision does not affect rights granted to consumers under mandatory law, including rights arising from a failure to deliver within an agreed or legally required period.

We will attempt to resolve the complaint directly and without undue delay.

If a consumer is not satisfied with the way we have handled a complaint or believes that we have infringed their rights, the consumer may request a remedy from us and, where the applicable legal conditions are met, submit a proposal for alternative dispute resolution to an authorised alternative dispute resolution body.

A current list of authorised alternative dispute resolution bodies is published by the Ministry of Economy of the Slovak Republic.

Consumers residing in another EU Member State may also contact the European Consumer Centre in their country for assistance with a cross-border dispute.

18. Governing law and jurisdiction

These Terms and purchase contracts concluded through our online store are governed by the laws of the Slovak Republic.

If you are a consumer residing in another country, this choice of law does not deprive you of any mandatory consumer protection granted by the law of the country in which you habitually reside.

Disputes may be submitted to the competent courts determined under applicable Slovak and European Union rules. Consumers retain the right to bring proceedings before a court competent under mandatory consumer-protection and jurisdiction rules.

19. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply. The affected provision will be interpreted or replaced only to the extent necessary to comply with applicable law.

The current version of these Terms is available on this page.

We may update these Terms where necessary due to changes in our services, business processes or applicable law. Changes do not retroactively affect purchase contracts concluded before the updated Terms became effective unless required by law or expressly agreed with the customer.

The version applicable to an order is the version in effect when the order is submitted.
